Trial of “Jovanjica 1”: Schedules, notebooks and records reviewed as evidence – Society

The trial of the owner of the “Jovanjica” marijuana plantation, Predrag Koluvia, and the other defendants, continued today in the Special Court with an inspection of the written documentation distributed in three binders.

At today’s hearing, agendas and notebooks were shown, which the prosecution claims support their suspicions that the narcotic drug marijuana was grown on the “Jovanjica” property itself.

In binder seven, there was an A5 format notebook, light green in color with the inscription “MPC.GPNH” written partly in Cyrillic and partly in Latin, which the prosecution claims represents the English words “MRS.GREEN”.

According to the prosecution, the schedule contains the names of the plants that were the subject of the expert examination, as well as the quantities.

The lawyer of the first defendant, Koluvija, Aleksandar Živanović pointed out as a remark that a criminal offense can only be discussed if the plants were physically found, and that the entries in the time sheets cannot constitute evidence in that way.

After that, a black diary of A5 format with the inscription “Jovanjica” was shown, which contained a list of on-call and work duties with the names and surnames of almost all the accused. The list also includes the name and surname of one person who is not on the list of accused.

According to the prosecution, the light blue diary of A4 format, with the inscription “2017”, contains the recorded production process for the mentioned year.

In the case files, two more schedules were also found, as well as three gray-blue notebooks marked “Practice diary of practical work”.

While the first two are marked with numbers, the name “Nursery” is written on the third.

In the mentioned diaries, as indicated by acting prosecutor Saša Drecun, the names of known types of Indian hemp are written in several places, among them “Painkiller”, “Geronimo” and “J-kush”, i.e. “Strawberry kush” or “Jagoda Kush”. .

The diaries covered three different growing periods, i.e. from 12.3.2018. until 18.6.2018, then 9.7.2018. until 26.7.2018, and finally on 12.1.2019. until 27.3.2019. year, and among the information that could be seen were data on the place of storage, the stage of cultivation, quantity and type.

Although the visibility of the public was difficult, in the courtroom one could see inscriptions in notebooks related to “cloning” of plants, “breeding”, as well as other processes in the cultivation of plants, which the defense claims are standard processes in the cultivation of various species fruits and vegetables, and that they are not specific for growing industrial hemp or marijuana.

Speaking about the diaries and notebooks, the prosecutor emphasized that they are extremely important evidence, because they record the production of narcotic drugs in the period from June 15, 2016 until the police raid on “Jovanjica”.

Predrag Koluvija’s lawyer, Vladimir Đukanović, asked the prosecution on the basis of which it was concluded that drugs were involved, and pointed out that what can be seen in the diaries and notebooks does not prove that, nor that a criminal offense was committed, “because they can only be read some numbers and letters that don’t mean anything”.

Also, in the courtroom today were presented correspondence and decisions of the Ministry of Agriculture, Forestry and Water Management, the Plant Protection Administration, the department for the recognition of varieties from different dates, which relate to the recognition and testing of plant varieties, primarily industrial hemp, grown by the company “Superior” from Velika Plana, which cooperated with Koluvia’s estate “Jovanjica”.

According to the prosecution, the aforementioned company produced hemp for the needs of “Jovanjica” and exported it.

The Rulebook on methods of testing the hemp variety, specifically the Cannabis sativa L variety, for the recognition of the variety, the Plan for setting up the micro-mirror, sample number 1 and sample number 2 in the localities of Sombor and Bački Petrovac, as well as numerous reports on the expertise of the Ministry of the Interior, as well as search of the premises of the company Superior on November 26 and 28, 2019.

Photos taken by the police on that occasion were also shown in the courtroom, and on them you could see glass jars and test tubes with plant material.

The first defendant, Predrag Koluvija, pointed out today that it is illogical that the jars, originally seized on the first day when the police raided the premises of the “Superior” company, can also be seen in the photos taken during the search held on the second day.

Prosecutor Saša Drecun responded by saying that Koluvija “disavows the court panel” with such allegations and explained that only plant material was seized on the first day of the search, and that test tubes and jars were seized on the second day.

The defense of Predrag Koluvija previously submitted a request to the Supreme Court for the protection of legality in connection with the decision of the Court of Appeal to return the previously separated evidence to the proceedings, and the president of the court panel, Judge Zoran Ganić, said that after the conclusion of today’s hearing, he would submit the case files to the Supreme Court for decision.

Only after the files are returned, a new date will be scheduled for the search in this procedure.
